John Ruiz files lawsuit against James Toney

James Toney defeated John Ruiz for the heavyweight boxing title, but then he tested positive for steroids and Ruiz was given the win. Now, though, Ruiz is filing a lawsuit against Toney, claiming that he suffered financially despite being restored as the heavy weight champion.
What I wonder is, why don’t they test before a title match? It is not as though it would be very difficult; two guys, with plenty of notice for when the match will be. That would have headed this whole thing off in the first place.
